Former Penn State defensive lineman Kevin Givens, who now plays for the San Francisco 49ers, is facing an assault charge from a confrontation with a man at a Baltimore hotel on Feb. 22.
Givens, a native of Altoona, 45 miles from Penn State, faces a charge of misdemeanor second-degree assault, according to ESPN. If convicted, that outlet reported, he could face up to 10 years in prison and/or a $2,500 fine.
These are some details of the incident in question, involving Givens and an alleged victim named Hayden Bosley. From the ESPN story:
The charge, which is for misdemeanor second-degree assault, stems from an incident that took place on Feb. 22 in which the victim, Hayden Bosley, said he suffered “a dislocated shoulder, a black right eye, bruises above his left ear and minor skin scrapes,” in the court documents, copies of which were obtained by ESPN.
According to court documents, Bosley said he was out with Givens, Givens’ girlfriend and another friend when they decided to return to the Sheraton Hotel. When Bosley asked Givens if he was going with them, Bosley said Givens got angry and the other three people in the party left.
After Bosley, Givens’ girlfriend and their other friend returned to the hotel, Givens arrived and allegedly attacked Bosley in the hallway on the fifth floor of the hotel. Bosley said he ran away to another nearby hotel and waited for a friend to take him to the hospital where his injuries were treated.
Givens is due back in court April 26. He just finished his second season in the NFL with the 49ers after being an undrafted free agent out of Penn State.
The 49ers released the following statement Friday:
“The San Francisco 49ers organization is aware of the media report regarding Kevin Givens. We are gathering the relevant facts of this matter and will continue to monitor the situation.”
Update with more details
The Sacramento Bee has more details, based on the affidavit from Bosley. This is from the Bee’s story Friday night:
Bosley and two others, including Givens girlfriend, returned to the hotel where Givens joined them when the alleged incident took place.
โKevin came not long after and saw all three of us standing in the hallway,โ Bosley wrote. โThis made him angry because he yelled when he saw us and then came down the hall walking quickly towards us.โ
The two women in the group tried to get in between Givens and Bosley.
โI was telling him to stop, asking whatโs wrong, and telling him, โIโm on your team,โโ Bosley wrote. โโIโm not trying to be against you.โ He then tackled me and dislocated my shoulder. From the ground and/or his limbs I received a black right eye, bruises above my left ear, and minor skin scrapes.โ
Bosley said one of the women they were with got between the two allowing Bosley to get up and try running away. He later got a ride from a friend to a nearby hospital to treat his shoulder and put it back into place. He said he was in the hospital from 3 a.m. to 7 a.m.
